The Apple vs. Samsung legal battle just took a surprising u-turn as it has emerged that Samsung has not demanded to see Apple's next generation iPhone and iPad.

Pursuant to Civil L.R. 37-2, Samsung's reciprocal expedited discovery requests to Apple are set forth in full below:

1) a sample of the final, commercial version of the next generation iPhone that Apple will release, whether that product will be known as the "iPhone 4S," "iPhone 5," or some other name, along with the final version of the packaging in which this product will be delivered to retail customers and a final version of the insert(s) that will be included within such packaging; and

2) a sample of the final, commercial version of the next generation iPad that Apple will release, whether that product will be known as the "iPad 3," "Third Generation iPad," or some other name, along with the final version of the packaging in which this product will be delivered to retail customers and a final version of the insert(s) that will be included within such packaging.


This move from Samsung comes after they were ordered to hand over examples of its Droid Charge, Infuse 4G, Galaxy S II, and Galaxy Tab 8.9 and 10.1. The aim is apparently so Apple can decide whether they should be a part of the company's original lawsuit over trade-dress infringement where the legal team from Apple claims Samsung's Galaxy S smartphone rips off the iPhone's UI and icons. This counter from Samsung does differ slightly however, as Apple has asked to see products that are already on the market (except Galaxy Tab 8.9) while Samsung wants to see products that are potentially only in development/beta testing. Neither Samsung nor Apple will actually see the devices - lawyers from both sides will be the only ones to witness them - the move is still one that raises eyebrows. Apple isn't known for sharing its prototypes with anyone (excluding the infamous iPhone 4!)

The consensus among the people in the know is that Samsung are on a bit of a fishing expedition here, claiming they need to see Apple's future devices so they can decide whether they may be similar to their own just in case Apple decides to go after them is a bit of a stretch, but when courts are involved anything could happen.

This will be an interesting story over the course of the next few days and weeks, with anything having the possibility to happen.
