It is Jail-Broken, but I would assume if I sent it to apple after updating it, it'll all be good.
So...I had this happen to me too with my iPhone 5. I feel like a lot of people have been having this problem. What I did was I first backed up my iPhone to iTunes so it was a full backup. Then i restored it (Yes i lost my jailbreak and you will too). Then i made an appointment at the apple store for the next day, I went in, told the guy that my lock button was not working and bam, brand new phone.
But, if you dont want to lose your jailbreak for now and you'll upgrade to iOS 7 when it comes out, you can go to settings>general>accessibility>assistive touch>on
Then a small white button will show up and when you click it click device>lock screen to lock your screen.
I didnt really use my jailbreak anymore so I just went ahead and swapped out my device at the apple store, but if you want to keep it and wait until iOS7, then you can do that. Just dont wait over 1 year because thats when the warranty runs out.
