I remember way back in the day when 3.55 was the newest firmware and myself and plenty other were banned from the servers for doing so. Is treyarch still watching and banning people on bo1 and bo2 for the same reason?

They don't give a fuck about BO1, and just use antiban eboot for BO2.

Just got 3 accounts banned within a week on a single console. Never console banned just account banned. I use assume they are just using my mac address to ban accounts associated with it.

you should use SENenabler to change your MAC address before getting online
