I mean... Its really F***ed up how they didnt even notify us about being 18+ for it to work... I personally consider this a scam or maybe a set up to make more money... But hopefully they refund us.

first of all.. why would they say you have to be over 18 when CLEARLY the game is rated 18+?
they have no legal obligation (nice word ) to tell you its only for 18+.

and i would have just put a 18+ DOB for whatever is preventing you now from getting COD Elite.

I think they should of made the age verification limit region specific since in Australia the game is rated 15+

it's because by using it, you're entering into a legal binding contract for the tourneys and such. And since you can't be under 18 and enter into a contract, you have to be 18+. There is the legal answer.

Guys this is Activision, don't be so naive as to think they'd actually do something with the consumer in mind, it's all money to them.
