If he gives someone the code to someone to become founder, does that person need to be a premium elite member in order to become a founder? Or can the person thats going to recieve the founder code be a regular elite member and then become a founder?

A Premium membership is required to use the Founder code and maintain the Founder status. Take a look through Auctions, plenty of users thought otherwise, only to discover that they were all wrong.

No you must be premium to use it. I've tried selling it to a guy who thought it gave you premium /facepalm

But yes you must be premium. This is Becuase founder status was given to those who upgraded to premium early.
