Also I belive even if they did inforce this they could not possibly imprison everyone it's just not feasible everyone has downloaded atleast one mp3 illegally imagine putting everyone in jail or fining them for that it would just be stupid and cost too much time and money.

Like you said, they can't technically do it because, like you said it is breach of privacy, but who knows...
