There are some basic questions that obviously strike you as illegal. For instance, questions regarding religion, race, ethnicity, disabilities, and even age are clearly not legal as an employer can be sued for appearing to discriminate on those terms.
In addition, your marital status, your country of origin or citizenship are off limits. Also added to this list are questions of sex, gender, and sexuality or sexual preference. These questions are illegal as they suggest possible discrimination.
The answers to them imply that they make you more or less suitable for the position and the law usually states that these qualities cannot be taken into consideration. Regarding the last set of questions, while gender is usually protected, sexual preference may not be in your state or locale. However, asking the question would of course be aggressive. Being aware of these boundaries is helpful as it gives you clear navigation for professional relationships.
Personal Questions May Come Up
Of course people want to make connections when meeting someone new and asking some of these personal questions may happen without any discriminatory intent at all. For instance, if an applicant mentions his or her children, marriage or a partner becomes a topic, and while it should be avoided, it may be difficult to.
Also, be aware of round-about questions to these topics. You may be sensitive to a direct question on any of these matters, but, as in the example above, it is not that hard to imagine something inadvertently popping up or an interviewer finding answers to these questions via certain cultural cues.
Finally, Keep This in Mind
If one of these questions comes up you may try to answer the question in a way that bypasses the discriminatory assumption. For instance, if the applicant is asked if they are a single parent, implying commitment to and availability for a position, the applicant can say that they have a very good grasp of their schedule and can navigate it with great success.
Whether its useful or not or you guys want it or not but My personal advice to you guys who facing the situation is that its better to avoid such silly/illegal questions only by distracting interviewer by answering him/her something else.
