it will be on 3.60 or higher, if u want a ps3 with 3.55 or lower u need to buy a used one from ebay or something similar, but if u buy a new ps3 in store u cant use cfw.

That is not true. I've bought 3 PS3's from walmart all on 3.21 firmware. It's all the luck of the draw with the store you go to. If you go to walmart and buy one that's on 3.60+ then return it and go to a different store. Most stores give you a 15 day return policy.

It also depends on where you go. Some stores might have some old PS3s in stock that they would want too get rid of first. Yo never know, might get lucky. If not, just return it and tell 'em it wasn't what you expected.

As Diji said it's just chance. You can return your PS3 if it's not on the firmware you desire if there is a return policy on it.
