You can't. You have to have a jailbroken ps3 and use a data transfer to transfer it to a 4.0 ps3.

No unfortunately there is no way of jailbreaking and being online at the moment. There are though many 4.0 CFW's being made at the moment so just wait and see. Hopefully it comes soon.

then what about the mods i see online, how did they get mods (which everyone says needs jailbreaking) and still get online

If you want to put patches onto your online ps3, you need another ps3 that is on 3.55 or lower, and jailbroken. The people with patches online patch it on their 2nd ps3, and copy it to their online ps3 through data transfer.
Or they patched if while they were jailbroken, then updated keeping the patch in tact.

So, to sum it up. You cannot get the patch without a jailbreak, and you cannot get online with a jailbreak unless you have a second jailbroken ps3.
