Best to data transfer just to be safe .. That's what i do .. Hope that helps

It's stupid but because you can't mod mw3 you can only mod some games if you data transfer

You can still mod Black ops 1 online without a console ban .. There is no point in modding Mw3 because loads of people do it so just hope you join there lobby 7 time's out of 10 you'll get in one and you won't get a console ban just a rest on stats which is a lot better
