If I leave it for about 5 mins off then it reads it again anybody know if it's the firmware or just messed up blu ray?

I think it might be the blue ray, I'm on the same CFW and I don't have that issue, however might be wrong so if anyone can input to this, it'd be great!

Have you test any other games? Easy way to find out is to pop the game in your ps3, open your game manger and copy it to you Internal HDD, once done play it off the internal HDD and if it still has that problem it's either your B-Drive lens is dirty or breaking And or Game fault.
