the rules been there for a very long time now, as long as you have created a PSN account, you agreed to them. In fact the last time Sony upgraded their Terms of Agreement was April of 2010 before the first JB hack, but even before that they had rules on running unauthorize material. It's common sense for any company to have this, i am sure it was in there the first time they even had the TOA
