Sony is crazy like that. They probably have some new thing where it saves your boot logs in the ROM or something.

as long as u connect to psn sony see's you are not on 3.56, so why bother

Sony know that your not running 3.56 ofw, because your ps3 has cfw and doesnt have a rootkit, which means that it is not responding to the remote code that is being executed by sony when connecting to psn.

I think its more like this:

To the people how have got the emails, you did something that Sony noticed, they have your PSNID and console ID. Thats not going to change whatever you do now.

Want PSN? You have to accept the new TOS which basically sum up to getting you to agree that if you do have anything on your HDD they don't like they can ban you.

Next step will probably be a check on the consoles that they have flagged and if they dont get the data they like (probably a response from the rootkit) your console ID will be banned for good. What leg do you have to stand on? You were warned (email), then you agreed (TOS).

So basically whatever you do now apart from updating to OFW3.56 will not help unless something is created that can send back to Sonys servers the response that they want from the rootkit you are out of luck. I feel this is not likley for a while as people are not yet exactly sure what Sony will execute. Even if it is captured then decrypted and a response emulated who is to say it will be the same way next time?

Something people need to get their head around is this will NEVER end. Sony will continue to monitor PSN and ban anyone that does not have their OFW so the initial choice is go about what you were doing with a JB console and a PSN hack while it lasts, or go to OFW.

There might be some better solutions in future but I doubt you will see them before this ban wave.
