You can transfer any patch from lower firmware to higher/same firmware. I don't think anyone has ever gotten banned from modding modern warfare 2, so don't worry. Currently challenge lobbies are patched on modern warfare 2, 1.12. But you can use an XP lobby patch.
I data transfer and host all the time, nothing to worry about.

If you're using the same ps3 that you got banned on, yes. The ban stores to you MAC address, so to get unbanned you would have to use a different ps3, but you could use the same account.
