In the latest repercussion of Sony's troubled firmware update, NeoGAF forum moderator ‘iapetus‘, cited European law to argue that his original 60GB console no longer operated as advertised.

The online retailler gave the gamer a refund - without return - of around 20 per cent of the console’s original value. The EU law, Directive 1999/44/EC, cited by 'iapetus' states: "(a product) be fit for the purpose which the consumer requires them and which was made known to the seller at the time of purchase.”

Amazon had to shell out rather than Sony as the directive puts the onus on the retailer rather than manufacturer, although the cost will probably be passed on to the electronics giant.

Sony maintains it can change software as it doesn't alter hardware. It will be hoping other PS3 owners won't be following 'iapteus' actions otherwise it will be forced, either to reinstall the 'Other OS' feature or go to court to show it's acting legally.

Personally I think this is ridiculous...
but then again, why should Sony remove a feature for all the early adopters of their system, if you think about it, that is one of the features we PAID FOR, what gives them the right to remove something we own just to cover their own backs?

Who cares, It's not like anyone even used the said feature. (0.05% probaly used it) Plus it's there product they have the right to add/remove anything they see fit or think will cause a problem to them.

Well, if it is advertised; then taken away, I think it should be Sony's fault.

Lets say I was the owner of Apple. Let's also pretend that I took away the screens on the the iPods that we sell from this point on. You can still listen to music, but you cannot see what your playing until it starts playing. It's my product, I can do with it what I want.

Would you buy my product still?


Granted, this is just a very small feature in the PS3.

But like them taking away backwards compatibility, a lot of people did not like it.

Soon Sony will take out the Blue-Ray players....
