1st of all you cant sue sony for YLOD its not high enough of a fail rate and falls well below the accepted fail rate of a consumer standards for a product

2nd they did not take away linux they took away psn YOU took away linux for updating your ps3
they have every right to exclude people from PSN
its in there terms and conditions thats what they done they never REMOVED linux just PSN
YOU REMOVED LINUX FOR AGREEING WITH THE UPDATE
if you updated your own ps3 obviously you have agreed for the removal of linux and clicked agreed on the F.W update if you want linux dont update

Not really, since at least one of the old updates was labeled as mandatory update and I'm quite sure 3.42 is mandatory too.

Which means that you're supposed to update to that firmware, but also that future games may not work without 3.42 installed.
Also, the inability to connect to PSN means you cannot download patches to fix games and DLCs.
Now, the inability to install a patch forces you to play a subpar version of a game or to update your console in order to fix your game.

That being said, I'm not american and won't benefit at all from any class actions, nor I would join one, however I think those law firms were not born yesterday and if I can come up with a couple valid concerns, they can probably come up with a couple dozen more ^^

you dont have to be sign into psn to get game updates
and its only mandatory if you wish to still use psn
but that sounds sorta right about new games coming out with requirements of F.W 3.42 or higher

has any game on the ps3 ever required a certain level of firmware to play? i dont remember one, except maybe the move games, because of Move wouldn't work on some of the older firmware.

YLOD is NOT their problem and When you installed 3.21 you AGREED to remove linux.

Not that I know of.
However it would make perfect sense, in my opinion. As long as firmware update can be done via bluray game disk (to prevent being sued from those who have a ps3 but cannot connect it to the internet, don't have a pc etc etc).

I wouldn't like it one bit, but IF all new games would be playable on jailbroken ps3s and it spreads (people not updating or keeping a secondary ps3), that would be an effective way to put a stop to it.
