After detailing some interesting contents of his battle with Sony in the court, infamous PlayStation 3 and iPhone hacker George Hotz has asked people to – if they want the legality of jailbreaking their PS3 resolved – file a declaratory judgment against Sony and go against them in court as he did.
On his personal blog, George Hotz said the following in an article entitled “To Any Stronger Than I”:If you’d like the legality of jailbreaking your PS3 resolved, file for a declaratory judgment on the issue. Keep it out of the ninth circuit, and you’ll probably have a good shot. To anyone seriously considering this, get in touch with me.For those who are ill-informed, a declaratory judgment is, courtesy of Wikipedia:A declaratory judgment is a judgment of a court in a civil case which declares the rights, duties, or obligations of one or more parties in a dispute. A declaratory judgment is legally binding, but it does not order any action by a party. In this way the declaratory judgment is like an action to quiet title, a paternity petition, or any other form of preventive adjudication. The declaratory judgment is generally distinguished from an advisory opinion because the latter does not resolve an actual case or controversy. A court may issue a declaratory judgment by itself or along with some other relief (such as an award of damages or an injunction). A declaratory judgment is sometimes called a declaratory ruling, a term which also includes decisions of regulatory agencies.A declaratory judgment is typically requested when a party is threatened with a lawsuit but the lawsuit has not yet been filed; or when it is thought by one of two (or more) parties that their rights under law and/or contract might conflict; or as part of a counterclaim to prevent further, similar lawsuits from the same plaintiff (for example, when only a contract claim is filed, but a copyright claim might also be applicable). Its a scare tactic most people will just see that and read 250k fine :O. I think that is bs what they going to do monitor him 24/7, Lets be honest there will be loopholes he connot buy a sony product but whos to say his mother/father cannot own a sony product :P ?

as another post by this person states though the $250,000 is a top limit. therefore yes he could get this by releasing on a $10 download per person. Who thinks that there would not be 25000 people willing to buy the jb from him? He is the most respected hacker out there and the most well known. Surely this is why whenever the idiots say there is a new jb he gets accredited with being the creator!
