You can return it even if you open it. Just go return it and go to a different store.

Nah I think I'll keep it... If i try to return it... My mom will kill me. I'll just leave it on 3.66... Or update to 3.73 and wait for KaKaRoTo to release his JB (if he ever does). Thanks man.

I don't think they ship 3.55 anymore. They probably updated all consoles before sending the shipments to the store.

You just got to be lucky and get one of the ones which were already in stock before they shipped newer ones out.
