i think so because to play it on the dashboard you have to pre-order it so theres a possibility

no i doubt you will get banned because you can't play the beta. It just loads up to a screen that states "the beta is not released yet" and it has only one thing to click on which is "exit"... So you cannot play the beta in any way. Especially because they don't have the servers running for the beta because in the beta its only multiplayer.
