You need 3.1.2 with the iTouch.

I thought so... any help upgrading 2.2 jailbroken to 3.1.2 ?

this is what you need to get
ipod touch 3.1.2 firmware
redsn0w or whatever jailbreak program you want to get
and your ready to jailbreak the ipod touch on 3.1.2
