go into manage > packages > uninstall the item you are currently trying to install> reinstall

i did that this morning and also 2 other things: i went into iFile and tried removing it that way and it didnt work. So i WinSCP'd ito my iTouch and officially removed it that way

It's saying that another package you have installed is using the same file. So you would have to uninstall the other package first.
