Just use redsn0w or greenp0ison. They are very helpful then you can unlock your iPhone from that and then cancel your AT&T plan.

What if I buy it used? & I want to jailbreak it from there and i'm looking for an older model anyways.

All iPhones have to be on 4.0 or lower(without a downgrade) to be unlocked... Or if the person whom u are buying from, conserved the baseband(very unlikely unless specified on eBay or wherever ur buying from... Usually only iPhone unlockers preserve the baseband)

The original iPhone the "iPhone 2G" and certain "iPhone 3G"(old bootrom) are unlocked for life.. Other iPhone's aren't.. The iPhone Dev team is planning to release an unlock for all iPhone's alongside with the 4.3 jailbreak..

Just get the 3GS. Cheaper than the 4 and has video on it with easier ways to jailbreak if it's on 3.1.2 or 3.1.3 Firmware.

It has to be on a certain firmware to jailbreak it?

I believe all the FW's are jailbreak-able. But the newer ones are harder to do. The older ones such as 3.1.2 and 3.1.3 are one-click jailbreaks.

No, It's just the easiest to do since the 3.1.2 and 3.1.3 jailbreaks are untethered.
