Is it like you get ban after 5 games or something or is it like if you dont show your menu and go online with it and nobody knows your modding then most likely you dont get banned?

Using non-host mods are less chances of getting banned. But PSN checks you're account, flags it if it shows activity of being CFW or OFW.
Using the patch & Ninja, helps it cover a little bit, you can still get banned.

Using a menu, honestly you can use a menu on Custom Games & you're chances of getting banned are very very low, it can still happen (experience on my side).

Also, depending on who you play or meet, I usually change my name so people won't know my true name & the reports will go to a "different" name. Well... To my assumption; it works till this day.

Nobody really knows your modding unless you show it. And menu's and anything will show. Try to not be so obvious about it.

Only PSN can identify if you are modding or not.
