And they sell their games as soon as they get it. Or you can google some game stores around your house to keep your self updated with wich one will get it first. BUT DONT GO TO GAME STOP.

How Do You Know They Will Deliver A Day Earlier?

All the stores get the games shipped to them weeks before the "release" date, so that they can have the games to sell on that day. Small stores tend to sell the games early so that more people will buy, but since they are small, they aren't really troubled by legal issues as much as the larger and more well-known stores.

Yh but i mean how do small companies acquire them, where do they get them from?

A warehouse from Treyarch presumably. I'm pretty sure you have to have a game shop license to order for your game shop to stock up. Its like costco for games but less public
