And everytime i try to go play online it says the servers are down .. i have not hack or modified the game on xbox in anyway .. its been like this for over a month now .. any ideas

your not banned... this has happened to me on and off on xbox too. I've never actualy talked to anyone who has this issue too, ive just seen threads on it on yahoo answers ect. Im trying to find a solution to this, So can u quote me and answer a few more things...
1. NAT type? (if u know)
2. When you get onto xbox, do your friends list show up as 0 for about 2 minutes?
3. can you join xbox live games, but get kicked later?
4. when u go to the multiplayer menu, go to options then hit select. (the button to the left of the xbox guide button.) There should be letters like a.b.c.d.e.f.g.h.i.j in that order. are there any missing (will apear as a -, like a,b,-,-,e,f,-,h,i,j) or are any out of order?

All that ^^^^ is important. I'm pretty sure you arent banned, like rocky said. If you wanna check that, have a friend check your stats. if you're level 1, your banned. if your not, its my problem. btw, try deleting your game updates. (not saved game data)
