The real question is will you be making a backup to share with the rest of us? And to answer your question, the servers will most likelly be up 3-5 days before release, so there is a chance, although I would bet on the weekend.

my guess is you will be console banned if you try multiplayer before release

Console ban will definitely apply for people using backup, but people with the original disc will just get reset.

Console banned? You can buy games online and they can be delivered early, I don't quite think they will ban your console if you play on it....

Im pretty sure you wont receive a ban if you play it online if you have the disk early, why would they turn on the servers before the games release date and not expect to see a few people on and just start banning people? if they dident want people to play it before it releases then they would keep the servers off till the night of the games release.
