More from the Activision vs Infinity Ward debacle as sacked ex-IW studio heads Vince Zampella and Jason West could retain the power to veto any future Modern Warfare releases, which could possibly affect DLC as well as the games themselves, according to Jas Purewal, associate at legal firm Olswang LLP (via GamesIndustry.biz).

Activision is also searching for internal documents - perhaps to serve as evidence - to support their allegations of "insubordination" and - get this - "Documents regarding West and Zampella's communications with Activision's competitors, including but not limited to Electronic Arts".

Could it have been that the ex-Infinity Ward duo were in communication with EA? That's what this seems to suggest and could be part of the reason Activision decided to let the pair go.

Activision meanwhile have issued their first public statement regarding the lawsuit launched by West and Zampella following their dismissal:

"Activision is disappointed that Mr. Zampella and Mr. West have chosen to file a lawsuit, and believes their claims are meritless," said an Acti spokesperson.

Aw. Poor 'ikkle Activision. They're all disappointed! After sacking two employees before paying them due royalties. Poor Activision.

This is all turning into a big, legal mess for both parties it seems, with the ex-Infinity Ward duo seeking control over the Modern Warfare brand and Activision maintaining that they've "done nothing wrong and intends to vigorously defend any claims asserted by West and Zampella" according to an internal memo doing the rounds before the lawsuit was filed.

It's not that i'm backing him up or anything, but isn't 402 just the messenger? (In other words, IW's bitch)

I think a lot of what comes out of his mouth is basically what IW just wants us to hear, he is basically their spokesperson.

Possibly, but either way you look at it he doesn't want to hear about things that are wrong with " his " game but he's more than happy to have 12 year olds who have just discovered Twitter and xbox lick his ass.

im sorry, what royalties? CoD franchise is owned by Activision, IW is owned by Activision, IW make Modern warfare series because activision say they can, they give them the right to make it and they can take it away just as easily

the two that were sacked deserved it tbh, mw2 is crap, anything and everything that is related to CoD is under the rights of activision, they dont have a leg to stand on

why would you sue one of the biggest gaming companies in the world? There's no way there going to win anything.

because if they were leaking/talking to other developers, then their reputation is down the crapper, no developer will take them on after this, so if they are doing a lawsuit, its to keep activision tied up in red tape and the public eye away from what activision sacked them for

For one, the co-founders actually own partial rights to the CoD franchise. It is also public knowledge that certain faults of mw2 are due to decisions Activision forced upon IW, ie: No dedicated server support via pc to lock in for sales of map packs, pushing the game to be released before being fully tested, allowing another developer to create a lesser CoD product which now includes a third developer, etc. IW was made by the community I seriously doubt they'd go against the massive community who made them which is the pc market. In the end we will never know all the facts, it is all speculation. Either way Vince Zampella and Jason West retain partial rights to CoD, the lawsuit is just. We all know Robert Kotick is scum and rather milk franchises for all the money their worth then make excellent triple A titles. To each his own on whose at fault and what has happened, but I will tell you this, if Zampella and West don't win rights to Modern Warfare, I bet within 2 years CoD will considerable die off in popularity, just look at Guitar Hero and how they tried to milk the franchise. I just can't wait for when they start charging a monthly fee to play CoD online, you think it's far fetched but with Kotick in charge monetize it all as much as possible all while screwing the gamers.
