Your ps3 will only get banned if it is jailbroken and you take it online WHILE it is jailbroken. If you update to 3.50 you will lose the jailbreak, but keep the mod.

IW Cannot ban consoles, they can only ban you from their servers. Sony though, doesn't care about Mw2 hacks, it cares about the Jailbreak. Just make sure not to take it online if you have the Jailbreak active.
