Then if someone without the patch downloaded it and restored it on their Ps3, wouldn't they have the patch?

No it wouldnt. Why? Because the PS3 detects the backup is from another PS3. Meaning you wont beable to restore.

Plus if it was possible we would all be doing it by now.

So if one ps3 craps the bed and you want to transfer over stuff, you cant because its a different ps3?
