Dedicated servers doesn't mean they're not owned by IW...
A dedicated server is just a server that is run from one single computer, as opposed to Matchmaking, which is just a bunch of players connecting to the player with the best connection.
The actual server containing all the MP information is owned by IW, as the one that contains all the MP information for Black Ops is owned by Treyarch.
On console, Treyarch don't have dedicated servers either, but they can still ban people, IW are just too lazy and really don't give a ****.

IW dont fully own the server themselfs which does not give them the legal right to ban people from using them it must be accepted by all owners of the server to stop someone from acsessing it.

search on "Free challenge lobbies mw2" in the forum and when you get in to a free CL then you can get it
