But anyways, I hated this one so I deleted it and copied the mossy one over again... started the game up, had the "SUBSCRIBE TO BLAH BLAH" there but when I start a private match I don't have a mod menu?

Simply try deleting your "Game Data" in the PSN XMB, then recopy your patch over ...
