2- There are players who are using their patch in a public lobby without being host. How is this possible? I had to boot a few of them on my hosted public lobby.

ok for one, you must of killed the guy and he saw the menu through the killcam. And it is impossible to use patches unless you are the host or unless the host is using a patch that does not use a verification system which automatically gives them the menu..
