Former Infinity Ward bosses: Jason West and Vincent Zampella have an official court date of May 7, 2012 to settle their dispute with Activision. West and Zampella seek $125 million in unpaid royalties from Modern Warfare 2 sales and wish to claim their contractual rights to the Modern Warfare brand. Activision sacked both developers in March 2010 for illegally consorting with EA, and has counter-sued West, Zampella and EA for $400 million, claiming EA stole its employees.
Since the firings, West and Zampella founded Respawn Entertainment and now have 40 former Infinity Ward employees working with them at the studio, which is creating an unannounced, blurry IP. Activision's suit is clear to proceed, but doesn't yet have a date -- considering how long this first case could drag on, we guess it'll go to court around January 2068.
What do you think about this, should they try to get $125 million or leave it? Should they try to get contractual rights to the 'Modern Warfare'? Should they have created Respawn Entertainment?

I think the two parties from Infinity Ward should get their unpaid royalties... I'm sure if it goes to court its going to bite Activision in the ass. That's just my opinion and seeing how they have 'lost' wages that they never received its most likely going to be ruled in the favor of IW.

Umm are you dumb? No offense, but Infinity Ward works for Activision along with Treyarch. IW and 3arc develop the games, and Activision puts their name on the box or 'publishes' it. Since Activision is such a big name since the late 1990s people tend to follow the mindset of 'Hey Activision endorsed Co Black Ops, lets get it!" etc.
