Well tell the guy that has it to go into the game, and hover over the emblem to see what it says down in the bottom middle. It should tell you how he got it.

It has no description, it says 'Unlocked via Call of Duty Elite'.
The system probably bugged and gave him the emblem by accident.

Might be for achieving the highest clan rank on ELITE.
