You noticed the words COUNTERFEIT GAMES are in there. So what that full statement MEANS is this...
If you modify your console/computer WITH the intent AND PRODUCTION/USE/Distribution, etc of COUNTERFEIT/Pirated games THEN you get the 10 years imprisonment.
SO BASICALLY you're getting placed into prison for the GAMES not modding your console. Same thing is here in the states. The Govt doesn't care in the slightest if you mod your system. THEY DO, however, care if you are involved with Piracy and in the distribution, production, AND use of Counterfeit/pirated games. Which is the truly illegal part of modding/hacking your game system. There is nothing illegal about modding/hacking your system other than violating the respected Companies EULA/TOS/User Agreements which is (USUALLY*) punishable in the [US] Court system as a fine and maybe probation along with the banning of your use of electronic devices (game consoles, cell phone, computers, ipods, etc.). Only in RARE and EXTREME cases are you imprisoned for modding/hacking your GAME system (I personally have never heard of a case of it), but computer hacking is viewed differently here in the States.
Computer hacking is not viewed as game console hacking. Here in the States computer hacking is viewed as a little bit more serious offense, DEPENDING on what you do. Like hacking bank accounts is bad, trying to hack into Govt files/places/networks is EXTREMELY bad, hacking websites IS illegal, and the list goes on and on.
NO MATTER WHAT anyone tells you, PROXIES DO NOT HIDE YOU! You leave digital finger prints everywhere you go on the net. Deleting things from your computer isn't really getting rid of them permanently. It's just changing it's file location, by compressing it, and placing it deeper in the Hard Drive where it can still be accessed by Law Enforcement Agencies with trained IT techs who can very easily get it.
Only way to get things permanently off your hard drive is to either permanently destroy it (drill holes in the HDD), or something like Derriks Boot-N-Nuke using the USDOD (United States Department of Defense) settings to destroy everything on your hard drive.
So people really misunderstand these laws.
Before anyone flames me, because they are not smart enough to understand what I have stated above, I am in computer classes so I DO know what I'm talking about it, and I'm planning on going to College for Forensic Computer Analyst. Which is someone who specializes in looking through computers to find evedience of Cyber based crimes, or crimes where computers were used.
Edit: IF you were imprisoned for this, you would NOT be placed with Murders. This is considered a White Collar Crime. Which basically means it's a non-violent offense so you would get placed in an extremely minimum security prison.
