This is old. This was discovered some time ago WAY back in one of the earlier versions of iTunes.
SADLY it's still there today, which a lot of people ask, HOW THE HELL DO YOU MAKE Nuclear and Biologiocal Weapons with iTunes? It's simply nothing more than a over glorified digital jukebox.
You'd think Apply would explain why they placed this clause in there, but I haven't heard a(n) official statement from them since the discovery of it.

note- how to make nuclear bomb.
step 1. combine all the Jonas Brother's music with Miley Cyrus
Step 2. Add Justin Bieber
Step 3. Put speakers in middle of city
Step 4. Put in earphones, start playing music and RUN AWAY FAST!
Step 5. Everyone in the city who does not have earplugs on will die.
You now know how to make a weapon that can kill everybody!
