In a new post on the blog of former NFL player Dave Pears (via GamePolitics), NFL retiree Bernie Parrish makes his and other retirees' intentions abundantly clear: "The retired NFL players who were used in Madden EA video games will be suing Madden and EA for using us in those games without compensating us," Parrish writes. He also alleges that "Madden's agent Sandy Montag boasts he and Madden collected over $100,000,000 in royalties while paying the retired NFL players used in those games absolutely nothing. Madden knows that the ugly truthful litigation is coming and is probably factoring that into his retirement."

Parrish also explains in the post that the players "probably will not use...the attorneys who obtained a $28.1 million verdict for us against the NFLPA for 'scrambling retired players identities' in those video games." He further states that, "In my opinion, Madden should have been included in our licensing suit against the NFLPA and so should EA."

The original class action lawsuit against the NFLPA (which included over 2,000 retired players) alleged that the organization conspired with EA to "scramble" the appearance of the retired players to avoid paying them royalties. The lawsuit also uncovered emails that showed the NFLPA locked the Pro Football Hall of Fame into a deal with EA at a rate that was deliberately "far below market value."






Its really mess up that Madden got to keep mostly all the money, but really now, do those players really need another 50,000 dollars to blow on cars thats just going to collect dust or mansions right next to the existing mansion. No, no they don't, so jst shut up and be greatful you get paid more in a month then most people for just catching a damn ball

wow, no one needs the amount of money those people get. Like there are people such as police fire ambulance and soldiers who risk their lives everyday or save live everyday and dont get anywhere near enough money they should do. Then you get people who catch balls or kick balls for a living and moan that they dont get enough money for it. Or teachers, in the UK, that say they want a pay rise and go on strike, not taking into consideration that they get paid more than soldiers on the front line, police, and fire and rescue who risk their life for other everyday.

Figured i would chime in being the maddenking and all. I think this is complete BS, there is no need for them to whine about not being paid when there all scrambled up. If Madden wanted you in the game they would pay you, but your asking prices are ridiculous. That is why you get scrambled it's fair business. It's called give and take and if you won't TAKE a price cut, then you are GIVIN nothing simple as that.

Yeah I understand that. Its entertainment, people love to be entertain, but come on., do they really have to bitch that there not getting sn extra 50k for being in a game. Back in the roman days day gladiators, who were pretty much the footbal stars of there time, there only prize was they got to live. Pretty much stop the player should stop bitching about having more money, stop buying 10 to 20 cars, you only have one butt. Stop spending your money on drugs and hookers, and be happy your not dirtydudeonline.

Only a certain few can be professional athletes, hence the elite group is payed so much. It may not seem 'fair' to you but it's all based off supply and demand. People want to see sports games. And that means you can jack ticket prices up which pays for the players basically. Being an athlete isn't 'easy' either. You don't just catch a ball or kick a ball.

When you look at EVERYTHING you can make it very simplistic. Banking and finance, just adding and multiplying numbers, business, selling things etc. Just because it seems simple on the outside, doesn't mean it's simple on the inside. Being a kicker, people just say 'Oh all you do is kick a ball'. It's MUCH more than that.

Wow. A Pro Athlete makes several million in a couple years. they then buy all the cars, clothes, mansions they want and then when their career is done, they wonder where all of it is. Because they spent it all so then now they want to get money any way they can. It's not really about them being used as characters, it's about them having no money and trying to take the money from a company that has done nothing wrong. Even if it was about the characters and not the money, the retired athletes are extremely selfish. I don't know about you but if madden put me in their game without paying me, I wouldn't be mad I'd actually be happy and consider it an honor. But with these people, apparently they're so great that it's not enough to be on a game when they're not even playing anymore and they're still on there being honored. No they have to sue Madden for "using characters likenesses".
