Seeing that the title and description legitly fit the product you are trying to sell, yes. The only problem I see is the (dumbass) buyer opens a dispute with ebay feeling that they got screwed and only got an Ipad box and no iPad clearly ignoring the title and description.

legally, Yes I would say so.

Just make sure in the description it says by bidding you agree you have read my description of the item. "Box for Ipad 32GB Version" then in small letters, "ipad no included"
