In California, if someone breaks into your house you have all legal rights to kill the people. It's called protection of self, protection of property. As long as they are within your house and you are not holding them hostage, you can inflict as much pain, cut them or shoot them (killing them).

Say I broke into your house, if you caught me you would have legal rights to pull out a gun and kill me because I am a unknown threat to you and your property. If I was to start running for your door, you still can kill me, the moment I open the door or jump out the window and make it to the front lawn however is when we reach the gray area and once I am off property is where it becomes murder.

Remember all murder is homicide but not all homicide is murder.

I believe that self-defense is: doing the minimum amount of damage to prevent yourself from being attacked further. Difficult formula but you know it when you have inflicted too much damage to be said as self-defense.

this isn't about self defense, but a burgular broke into someones house, and fell down the stairs as they tripped on a up broken bit of carpet and tried sueing the home owner and won :dumb:

I would get my 16 gauge out of my closet and give them a chance to get the **** out of my house. If they didn't comply I would do what is necessary.

Self defence should be just that,nothing more.
Individuals should not be convicted/charged in defence of themselves or their loved ones of an assault by an assailant regardless of the actions taken period.
Any intruder that even sets foot into the perimeter of your home should be seen as a threat and by law,one has the ability to use any force necessary to deter said intruder.
But sadly,it is not always the case.
There was a story(in OZ) a few years ago about a burglar who broke into this upmarket house but was confronted by the owner.
In the midst of this struggle,trying to escape,the burglar somehow fell and broke his leg.
Now,the stupidity of this story starts to surface when the burglar sues the owner for using excessive force resulting in the broken leg.
And guess what?
The burglar won the case./facepalmNo

If someone is in YOUR house uninvited, you should be able to do what is necessary to get them out, even if it ends with them in a body bag. THEY chose to come into your house, most likely with the intention of harming the occupants. Do they think about it? No, they do it. You have to protect your family, especially your kids. If they are in your house, you should be able to defend yourself, however once they leave your property, then it's not self defence any more, it could be murder. I thought the rules of self defence were changing in the UK. I remember some guy got let off after stabbing to robbers. This guy is getting charged? What the ****?

I also remember some farmer shot and killed some gypsy burglars and was found guilty. Shit's ****ed up. Things tend to work in favour of the bad guys. Like getting 50in Plasmas in their cells.

Way I see it, if some burglar enters my house, anything is justified to get them out.
