The Scripthook, which loads the ASI files, injects itself into memory. You can't 'bypass' it without completely redefining how mods are used in-game.

Yes, they've added 6 new natives which sniff out injected dlls and hashes and auto-bans when any are detected. Some have reported been banned in Singleplayer (received the "Banned!" notification as if online).
