Both companies are extremely profitable and popular, with HTC being regarded as the third-biggest mobile phone creator and Apple dominating the MP3 and computer markets. So, what’s the beef?
According to a recent report from the BBC , Apple has filed a complaint with the International Trade Commission against HTC for five patent infringements. Apple, which is responsible for the iPad, iPod, and the Macbook, claims that the Taiwanese-based HTC infringed on the “software architecture and user interfaces in portable electronic devices, hardware for touchscreens and movement sensors.” In other words, Apple and HTC are battling because both companies have similar mobile phone and tablet features. Apple is attempting to halt the U.S. import of HTC’s new Flyer tablet computers because it has similar components to the extremely popular iPad.
Of course, HTC has denied the patent infringement allegations and will defend their product in court. “HTC is dismayed that Apple has resorted to competition in the courts rather than the market place,” Grace Lei, HTC’s general counsel, told Forbes.
This newest development comes as little surprise for those who have been the following the HTC vs. Apple saga. Apple has already filed a suit against HTC with the International Trade Commission for patent infringement on “personal data and mobile communications devices and related software,” and several other claims. That particular case will not be resolved until after August, when the two companies are set to appear in court. If that weren’t enough, HTC sued Apple in 2010 for five patent infringements as well. HTC claimed that Apple devices use their technology for “telephone dialers with easy access memory and power control methods for portable electronic devices” and sought an immediate ban on sales of iPhones, iPads, and iPods in the United States. That case will not be resolved until September.
According to Zacks Equity Research, Apple has dominated the tablet and smartphone market with the release of the iPad and the iPhone. Now, the Steve Jobs-led Apple is facing stiff competition from HTC, Samsung, Motorola and other companies since the Android market is equally as popular and accessible as the iOS Apple market. Data collected for the three months by Comscore, Inc. revealed that android based devices dominated 38% of the market share in the US while Apple’s iOS only had 27% of the market share.
It appears as if Apple’s monopoly decline is prompting their decision to file suits against both HTC and Samsung. Their method might be successful since HTC’s stock dropped 5 percent after the announcement and is expected to continue to decline in coming weeks. Apple has signed on the dotted line.
