A moral victory for many youth-gaming enthusiasts today, as a US Supreme court opposed a rather controversial topic. On a seven to two vote count, the court settled to ensure violent video games will not be banished from purchase by youths within California. Those voting on the matter acclaimed that video games fall under First Amendment protection, and therefore cannot be restricted from certain groups.

"Like protected books, plays, and movies, [video games] communicate ideas through familiar literary devices and features distinctive to the medium. And 'the basic principles of freedom of speech . . . do not vary' with a new and different communication medium," said the court.

"This country has no tradition of specially restricting chil- dren's access to depictions of violence. And California's claim that 'interactive' video games present special problems, in that the player participates in the violent action on screen and determines its out- come, is unpersuasive."


Dating back to it’s initial bill debut, Governor Schwarzenegger signed the matter which went against the sale of violent video games to minors. If it had been accepted, the bill would have allowed retailers to receive a maximum $1,000 fine per each violation (Per violent game sold to a youth). Also, much like some CD’s warning, video games with known violence would have been required to have a 2” black and white sticker on the front notifying gamers of its nature.

Though there is a wide tolerance to what many consider “violent”, the bill sought to banish games in which “….the range of options available to a player includes killing, maiming, dismembering, or sexually assaulting an image of a human being."

Rest assured, many now can breathe a sigh of relief, especially those in the state of California. With the denial of the bill, young gamers can continue to purchase, play, and ultimately enjoy some of their favorite blockbuster titles.

Yeah this is great! either way if they ever decide to ban violent video games I think I could then get a life...

I don't understand why this was so big. So if passed there would be a $1000 fine for selling violent games to minors when violent games are rated M and are only supposed to be sold to 17+ anyways? :dumb:

Eh, that's debatable... you guys are good, but not necessarily better. You're just more up to the job, whereas others only want to post what's most beneficial to them. (i.e. What will get them the most thanks.) Still, keep doing what you do. :y:
