The small catch is that owners must purchase the digital version of the game (or the Digital Guardian Edition for the offer to count); physical copies of the game won’t cut it. The Expansion Pass (which includes two announced expansions for $34.99), however, will be supported regardless of how you get it. Because it's a digital copy you have to buy, there won't be any way to then give your old game to a friend, which is likely why Activision is willing to offer this.
The last-gen version you buy dictates which current-gen version you can upgrade to. In other words, if you buy the PS3 version, you'll only be able to get the PS4 version, while the same holds true for Xbox 360 and Xbox One. Either way, upgrading to a current-gen version won't prevent you from continuing to play your last-gen copy. And because your progress transfers between platforms (within the same console family), you won't leave to start over when you move from PS3 to PS4 or Xbox 360 to Xbox One.
In order to redeem your new-generation copies, you'll need to sign in on a PS4 or Xbox One, as the case may be, no later than Jan. 15, 2015. Once you log in, you'll have to go to the PlayStation Store or Xbox Games Store, respectively, then add the (free) content in question to your cart and "buy" it. That said, after making the upgrade, both copies of the game will still be playable, as the licenses will be tied to your PSN/Xbox Live account. And if you were worried about losing your Guardian characters in the process, don’t. All that information carries over, regardless of whether or not you participate in the last-to-next-gen upgrade or not.
