Also, say other people play trophies for me legit on their console, will they get banned for being tied to my account even though they are not activated?

If you're on CFW then you'll need to buy a new 100% private CID which aren't sold here to unban your console. The accounts on your PS3 will end up banned at some point as well if your console banned so it's best to make all new accounts after getting a new CID.

There is a chance his account could be banned yes.

Suffice to say, Sony can detect if a CID is being used by a jailbroken PS3. A legit user would be more safe than you.
