yes you would need to have your account on the CFW. If not, all copy protected saves will not transfer.
hopefully, you can register your account on your CFW even if it is not 3.7 (at least it worked for me when 3.66 was latest firmware)

No you can't

The only realistic way would be to add your account on a 3.70+, and then downgrade through one of these soldering methods. At least it's possible.
