yes you face the threat of getting banned. But obviously only if you promote it in some way that gets others to join in a major way. Geohot openly published Sony's keys. Under court order, they were to be removed from public eye until agreements have been made. Additionally, you are right in saying the main purpose was to allow the jailbreaking of ps3's to be legal. But all it really comes down to is piracy and intellectual property. jailbreaking isn't essentially illegal because you can "hack" the ps3 without keys. At least, that is what Sony is trying to protect right now (the keys). It is also garunteed they will change their terms of illegal and legal to be more controlling in the future when we see the latest jailbreak out.
All in all, Sony won't personally hold anything against you on 3.55 unless you figure a way to get 4.11 cfw.
