Technically it's illegal to make money off something you don't have the rights to or permission.

I dont think it is because it is only illegal to pirate games but modifying a game or console is not illegal to do because your tampering with something you own. someone correct me if im wrong.

pirating games (torrents, aka "Warez") is illegal ,and not allowed here in NGU.
Modding games, and selling it, is not illegal, however, it does not mean that sony got nothing to ban u, sony got 1 enough reason (owning a CFW)

It is not illegal to actually own a jailbroken system and to mod a game. It is illegal to download pirated games and sell services.
