A few weeks ago i bought a game from the Playstation store,
but then I formatted my ps3 so my games and saves are gone and then i got a CFW (4.76 Rebug DEX)
but can i download the game again from the store (without getting banned) or not?

The moment you log into an account on PSN, it is forever at risk of ban..So, yes, you can, but you will still be at risk of being banned.
