I returned it today and went to argos to buy a new 1 but they said i can only return it if its faulty. If i buy it and its on 3.50 im screwed.
i rang up sony today and they said it depends on how long its been in stock for depends the software. by 5pm today GMT i will be buying one but how can i make sure where i get it from it is on older software???

Im not sure but you should have asked them when there ps3's were shipped cause if it was before 3.42 or close to the date you should be safe

Exchange shops are your best bet, if not, go on eBay and pick up a YLOD PS3 as long as you know how to fix it (about £30 - £40) and if it isn't on firmware 3.41 or below then go and exchange it and HEY you've made a profit .

went to a exchange shop called cex. got it for £165 without box tho. Plugged it in last night checked the fw and...... 3.30!!!!!!
