There is no proof of that, the device was even deemed legal by a court as the original did not use any of Sony's code.

Because on 3.41 and 3.50 the PS3 does not boot from the USB device.
So you cannot install PSGroove.

PS3 patched the exploit by changing the coding for developer mode
It used to be Power button + Eject
They cant remove it so we just need to look at the changes between the 2 Firmwares and re - enable developer mode
Then un-signed USB's can run HEX files
